Terms and Conditions of Sale

Last updated: 26 October 2026

1. Definitions

The "Buyer" means the customer who accepts a quotation of the Seller or whose order for the Goods is accepted by the Seller.

The "Seller" means Nimbus Designs Ltd, trading as Bestcables.

"Conditions" means the conditions of sale set out in this document and any special or additional conditions agreed in writing by the Seller.

"Goods" means the goods (including any instalment of goods or any parts for them) which the Seller is to supply in accordance with these Conditions.

A "Consumer" means a Buyer who is an individual acting for purposes wholly or mainly outside their trade, business, craft or profession. A "Business Buyer" means any other Buyer.

"Writing" includes email and other comparable means of communication.

"Working Days" means Monday to Friday inclusive, excluding Saturday, Sunday and bank holidays.

"Including" and "in particular" do not limit the general words they follow.

2. Conditions

These Conditions apply to all contracts for the sale of Goods by the Seller to the Buyer, to the exclusion of any other terms the Buyer may try to apply under a purchase order, confirmation of order or similar document.

Where the Seller has agreed to provide system design, installation or other consultancy services, those services are governed by the Seller's separate Conditions for the Provision of Services, a copy of which will be supplied to the Buyer.

No variation or addition to these Conditions is effective unless agreed in Writing by the Seller.

The Seller's employees and agents are not authorised to make representations about the Goods unless they are confirmed by the Seller in Writing.

Any typographical, clerical or other error or omission in sales literature, quotations, price lists, acceptances, invoices or other information issued by the Seller may be corrected. If an error affects the price or description of Goods you have ordered, we will contact you before despatch and you may cancel the order for a full refund.

A contract for the sale of Goods is formed when the Seller despatches the Goods. The Seller will inform the Buyer by email when the Goods have been despatched.

Nothing in these Conditions affects the statutory rights of a Consumer.

3. Prices

The price of the Goods is the price shown on the Seller's website at the time of ordering, or as otherwise agreed in Writing. Special offers are subject to availability.

Prices of Goods are shown inclusive of VAT. Delivery charges are shown excluding VAT and are added at checkout, where the total including VAT is shown before you pay.

If the price of Goods you have ordered changes before despatch, we will tell you before taking payment and you may cancel the order. If you have already paid in full, the price will not be increased without your written agreement.

Prices on the website may differ from prices in printed sales literature.

4. Payment

Payment must be made in full before the Goods are despatched. We accept payment by debit and credit card and by PayPal.

Payments made by cheque are subject to a 5 day clearance period starting from the day the cheque is paid into the Seller's bank account.

For Business Buyers with an agreed account, time for payment is of the essence and failure to pay entitles the Seller to delay delivery until payment is received, without prejudice to any other remedy.

Receipts for payment are emailed automatically.

5. Delivery

Our standard delivery service is by courier using DPD.

Orders for in stock Goods placed by 4:30pm on a Working Day are normally despatched the same day. Orders placed after 4:30pm, at the weekend or on a bank holiday are despatched the next Working Day.

Next day courier deliveries are made on Working Days. The estimated delivery date is the next Working Day after despatch, and orders despatched on a Friday are delivered on Monday (except bank holidays). Before 10:30am, before noon and Saturday delivery services may be arranged on request before ordering.

Delivery times are estimates. The Seller will make every reasonable effort to meet them. For Business Buyers, time of delivery is not of the essence and the Seller is not liable for losses arising from a failure to meet an estimated delivery date. For Consumers, if the Goods have not been delivered within 30 days of the order (or any later date agreed), the Consumer may cancel the order for a full refund.

The courier may notify you of your delivery by telephone, text message or email. Deliveries may take place up until 6pm unless otherwise agreed.

Unless otherwise agreed, the Seller may deliver an order in instalments. A delay to one instalment does not entitle a Business Buyer to cancel the remainder of the contract.

Goods will be delivered to the delivery address given with the order, and the Buyer should make arrangements to accept delivery.

The method of despatch is at the Seller's discretion. Where a particular delivery service has been paid for, the Seller will make every effort to use it, but may use an equivalent or better service where needed to ensure the order is properly insured.

If nobody is available to accept a courier delivery, the courier will usually leave a card or send a notification and try again on the next Working Day. The courier's electronic record of a failed attempt will be treated as evidence of attempted delivery. After two failed attempts the parcel will be held at the courier's local depot for five days for collection. If it is not collected it is returned to the Seller, and the Buyer will be charged a return fee of £9.90 plus the original delivery charge plus VAT. If the Buyer would still like the Goods, a second delivery charge applies. If the Buyer no longer wants the Goods, the price of the Goods will be refunded less these charges.

Once despatched, a delivery can be redirected to a different address for a fee of £11.95 plus VAT.

Please check your delivery when it arrives. Damaged or missing items should be reported to us in Writing within 5 Working Days of delivery with a full description, so we can claim from the courier and put things right quickly. This does not affect a Consumer's statutory rights in respect of faulty Goods.

Our online checkout delivers to UK mainland addresses. Delivery elsewhere is by arrangement before ordering. Any promotional delivery offers apply only to UK mainland and Northern Ireland addresses.

Where Goods are offered with free delivery, the delivery method is at the Seller's discretion and these delivery terms apply.

More details are on our delivery information page.

6. Ownership and Risk

Risk in the Goods passes to the Buyer on delivery.

The Seller remains the owner of the Goods until the Seller has received payment in full.

For Business Buyers, until ownership passes, the Buyer holds the Goods as bailee for the Seller, must keep them separate, properly stored, insured and identifiable as the Seller's property, and must not pledge or charge them. If payment is overdue, the Seller may recover the Goods and the Business Buyer shall be liable for the costs of doing so.

7. Your Right to Cancel (Consumers)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, a Consumer may cancel a contract for Goods bought online at any time from placing the order until 14 days after the day the Goods are delivered. Where an order is delivered in several parts, the 14 days run from the day the last part is delivered.

To cancel, please tell us clearly in Writing, for example by email or using our contact page, and include your order number. You do not need to give a reason.

You must send the Goods back, or hand them to us, without undue delay and no later than 14 days after telling us you are cancelling. You pay the cost of returning the Goods unless they are faulty or not as described. Please pack them carefully, as you are responsible for the Goods until they reach us; we recommend using a service that gives proof of posting.

We will refund the price of the Goods and the cost of standard delivery within 14 days of receiving the Goods back, or of you giving us evidence that you have sent them back if that is earlier. If you chose a faster or more expensive delivery service, we will refund only the cost of our standard delivery. We refund using the same payment method you used.

You may handle the Goods as you would in a shop to inspect them. If they have been used or handled beyond that and their value has been reduced as a result, we may deduct an amount from the refund to reflect the reduction.

The right to cancel does not apply to Goods made to your specification or clearly personalised, such as cable cut to a length you specified.

The right to cancel applies to Consumers only. Business Buyers may return Goods only with the Seller's agreement, and returns accepted from Business Buyers are subject to a restocking fee of at least 10%.

8. Faulty Goods and Your Statutory Rights

The Seller warrants that the Goods will, at the time of delivery, correspond with the description given by the Seller.

If you are a Consumer, you have legal rights under the Consumer Rights Act 2015: Goods must be of satisfactory quality, fit for purpose and as described. If Goods are faulty you may reject them for a full refund within 30 days of delivery. After that, you are entitled to a repair or replacement and, if that is not possible or does not fix the problem, a price reduction or refund. Nothing in these Conditions affects these rights. Further information is available from Citizens Advice.

If you believe Goods are faulty, please contact us in Writing describing the problem. We will give you a returns number and instructions. Please keep the Goods and their packaging so the fault can be checked. We will refund the reasonable cost of returning faulty Goods by Royal Mail Second Class post, or arrange collection; please contact us before using any other service.

The warranty does not cover damage caused by fair wear and tear, wilful damage, accident, misuse, failure to follow the Seller's instructions, or alteration or repair of the Goods without the Seller's approval.

Where Goods are covered by a manufacturer's warranty, the Buyer may also benefit from that warranty.

Goods not shown on the Seller's website or in its catalogue may be subject to different return arrangements, which will be confirmed before you order.

9. Business Buyers: Claims and Liability

This section applies to Business Buyers only.

Any claim based on a defect in the quality or condition of the Goods or their failure to meet the specification must be notified to the Seller within 7 days of delivery or, where the defect was not apparent on reasonable inspection, within a reasonable time after discovery. Goods must not be returned without a Return Material Authorisation (RMA) number from the Seller, must show that number clearly on the parcel and should be returned in their original packaging complete with accessories and documentation. The Business Buyer is liable for the cost of remedying damage caused by inadequate packaging. Where a valid claim is notified, the Seller may at its option repair or replace the Goods free of charge or refund the price, and shall have no further liability. No credit will be given for Goods returned that the Seller finds are not faulty, unless agreed in Writing.

The Seller shall have no liability for any defect arising from a drawing, design or specification supplied by the Buyer, or for any incompatibility issues, and has no liability under the warranty if the price of the Goods has not been paid when due.

Except where liability cannot be limited or excluded by law, all warranties, conditions and terms implied by statute or common law are excluded to the fullest extent permitted, and the Seller is not liable for any indirect, special or consequential loss, including loss of profit, anticipated savings, business, revenue, contract, goodwill, use or data, downtime, or the cost of procuring substitute equipment. The Seller's total liability under or in connection with the contract shall not exceed the price of the Goods.

The Seller may, at its option, refer any dispute with a Business Buyer to arbitration under the Arbitration Act 1996.

10. Our Liability to Consumers

If we fail to comply with these Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence. We are not responsible for loss or damage that is not foreseeable, or for business losses. Nothing in these Conditions limits our liability for death or personal injury caused by our negligence, for fraud, or for breach of your statutory rights.

11. WEEE and RoHS

All products sold by the Seller are sourced from UK based WEEE registered suppliers and conform to RoHS. As a seller of electrical and electronic equipment, we will take back your old equipment for recycling when you buy a new equivalent product on a like for like basis. Please contact us for details.

12. Customer Service

The Seller will make every reasonable effort to respond to queries within 48 hours, and to complaints within 7 Working Days, keeping you informed of progress after that.

Telephone calls to the Seller may be recorded for training purposes.

13. Trademarks

The Seller and Buyer acknowledge the intellectual property rights of the suppliers and manufacturers of the products shown on the Seller's website and in its sales literature.

Where Goods are made under an ISO 9001 approval, this is indicated in the manufacturer's information.

14. Events Outside Our Control

The Seller is not liable for any delay or failure to perform its obligations caused by events beyond its reasonable control, including acts of God, explosion, flood, storm, fire or accident; war, terrorism, civil disturbance or requisition; acts or restrictions of any government or authority; import or export regulations or embargoes; strikes or industrial action; difficulty obtaining materials, labour or machinery; power failure or breakdown of machinery; and severe weather. If such an event delays your order significantly, a Consumer may cancel the order for a full refund of anything paid for Goods not yet received.

15. General

If the Seller does not insist on strict performance of any of these Conditions, that does not waive its rights.

Notices under these Conditions must be in Writing, sent to the other party's registered office, principal place of business or email address last notified. A notice sent by email is treated as received when sent, and a notice sent by first class post 48 hours after posting.

If any part of these Conditions is found invalid or unenforceable, the rest of the Conditions are not affected.

These Conditions are governed by the laws of England and Wales. Business Buyers submit to the non-exclusive jurisdiction of the English courts. Consumers may bring proceedings in the courts of England and Wales, or, if they live in Scotland or Northern Ireland, in the courts of their home country.
